The use of the Supaflow Product and Professional Services is subject to this Acceptable Use Policy (AUP). Unless otherwise specified, capitalized terms not defined here have the meanings given in the relevant agreements between the Customer and Supaflow regarding the use of these services (the “Agreement”). If terms are not defined in the Agreement, they are explained in the Master Subscription Agreement available at https://www.supa-flow.io/legal.
1. Use Restrictions
The Customer is obligated to use the Supaflow Product and Professional Services in accordance with the terms outlined in the Agreement, Documentation, and this AUP. They must not, nor allow, enable, or support any User or third party to, either directly or indirectly, do so.
(a) Use the Supaflow Product or Professional Services in violation of any applicable laws or regulations, in a manner that infringes third parties' intellectual property or privacy rights, or for any fraudulent, deceptive, or unethical activities;
(b) Do not use the Supaflow Product or Professional Services in a manner that could cause significant harm to Supaflow or others, or interfere with another Customer’s authorized use of the services, including but not limited to:
(i) Posting, uploading, forwarding, or transmitting files or software containing or launching viruses, worms, Trojan horses, or other malicious or destructive features, or interfering with the proper functioning of any Supaflow Product;
(ii) Attempting to probe, scan, or test the vulnerability of any Supaflow Product, breaching security or authentication measures without proper authorization, or intentionally rendering any part of a Supaflow Product unusable; or
(iii) Using or configuring the Supaflow Product to bypass any restrictions or requirements outlined in the Agreement or this AUP.
(c) Using the Supaflow Product or Professional Services must not infringe on Supaflow’s intellectual property rights or create direct competition with the company. This restriction includes, but is not limited to:
(i) Reverse engineering, decompiling, disassembling, modifying, creating derivative works from, deriving from, or attempting to access the source code of any Supaflow Product;
(ii) Utilizing or accessing any Supaflow Product or Professional Services to develop a competing product or service, conduct competitive analysis or benchmarking (except for the Customer’s internal use), or publicly share performance data or analysis of any Supaflow Product or Professional Services;
(iii) Removing any proprietary notices or labels from any Supaflow Product or deliverables provided during the Professional Services.
(d) With respect to On-Prem Software:
(i) Translating or localizing any On-Prem Software;
(ii) Reselling, encumbering, selling, renting, leasing, sublicensing, displaying, publishing, disclosing, or transferring rights to any On-Prem Software, wholly or partly, to third parties; or
(iii) Permitting any third party (except contractors who are Users) to access or use the On-Prem Software.
(e) With respect to AI Features:
(i) Use AI Features or any AI-related content to develop, train, or enhance artificial intelligence or machine learning models, or to support the development, training, retraining, fine-tuning, testing, or improvement of products or services that compete with Supaflow Products or the AI Features;
(ii) Rely on AI Features to make decisions with significant legal or similar consequences (such as employment, credit, or healthcare decisions) without proper human oversight and review; or
(iii) Claim that the Output from any AI Features has been approved or validated by Supaflow.
2. Violations
Customer must promptly report any breaches of this AUP to Supaflow Legal (legal@supa-flow.io) and, if asked, cooperate in investigating or resolving such breaches. If the Customer breaches this AUP, Supaflow may exercise all rights or remedies available under the Agreement, whether legal or equitable.
3. General Terms
Except where the Agreement states otherwise, if there is any conflict between the Agreement and this AUP, this AUP takes precedence. Supaflow may periodically revise this AUP with reasonable notice, including through the Supaflow Product or by posting a new version on its website. When updates are made, the effective date at the top will be updated accordingly. Customer’s continued use of the Supaflow Product or Professional Services after the effective date of the updated AUP constitutes acceptance of the updated AUP.
